Overview

Australia’s Partner visa program enables the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to reside in Australia. The program comprises several visa subclasses, tailored to accommodate different relationship circumstances and whether the application is made onshore or offshore.

Main Visa Options

1. Subclass 820/801 – Onshore Partner Visa

  • Subclass 820 (Temporary Partner Visa): The initial stage of an onshore application, lodged while the applicant is in Australia. It provides temporary residence, allowing the applicant to live, work, and study in Australia while awaiting assessment of the permanent stage.
  • Subclass 801 (Permanent Partner Visa): The permanent stage of the onshore partner visa, generally considered around two years after the Subclass 820 application lodgement. Once granted, the visa holder obtains permanent residency with full rights and entitlements.

Best suited for couples who are already living together in Australia.

2. Subclass 309/100 – Offshore Partner Visa

  • Subclass 309 (Provisional Partner visa): This is the first stage of an offshore application, lodged while the applicant is outside Australia. It allows entry and temporary stay in Australia while awaiting the permanent stage subclass 100.
  • Subclass 100 (Permanent Partner visa): The permanent stage of the offshore Partner visa pathway, generally granted after holding a Subclass 309 visa. It is generally assessed about two years after the initial 309 application, unless the relationship is long-term or children are involved, and requires the relationship to remain genuine and continuing.

Designed for couples where the partner is still overseas at the time of application.

3. Subclass 300 – Prospective Marriage Visa

  • The Prospective Marriage visa is for applicants who are engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • It allows entry into Australia for up to 9 to 15 months to marry the sponsor.
  • Once married, the visa holder can then apply for an onshore Partner visa (820/801).

Best for fiancés who are not yet married or in a de facto relationship but plan to marry in Australia.
